## Terms & Conditions

**Alfayha Institute proudly presents the Alfayha Institute Award Go to Dubai 2025 (the “Event”).** This Event is offered subject to the rules set out below (“Rules”). These Rules form a binding legal agreement between Alfayha Institute and you (“Participant” or “you”) and set forth the terms and conditions for your participation in the Event available on the Alfayha website and related services (“Alfayha Services”). Winners will be announced on Jan 24, 2025 (“the Awarding Night”) at [22:00:00 UTC+4].

Alfayha’s Terms of Service, Privacy Policy, and other relevant policies apply to your participation in the Event. These Rules shall be governed and interpreted as set out in our Terms of Service. Capitalized terms not defined in these Event Rules have the meanings given to them in our Terms of Service. The Event Rules are set forth below.

Please ensure you have access to all Event features by using the latest version of our platform.

### 1. CATEGORIES AND NOMINATIONS Alfayha Institute nominates participants based on various factors, including but not limited to: activity, growth, profile statistics such as followers and engagement, content quality, account consistency, and performance. Participants are nominated at the sole discretion of Alfayha Institute. Up to six participants will be nominated for each of the following categories: 1. Participant of the Year 2. Project of the Year 3. Breakthrough Innovator of the Year 4. Visionary Award 5. Changemaker of the Year 6. Entertainment Participant of the Year 7. Sports Participant of the Year 8. Education Participant of the Year 9. Fashion and Beauty Participant of the Year 10. Culinary Participant of the Year 11. Lifestyle Participant of the Year

### 2. VOTING **Voting Period:** The voting period for all categories opens on Dec 25, 2024, at [12:01 a.m.] [UTC+4] and will close on Jan 7, 2025, at 11:59:59 p.m. [UTC+4] (“Voting Period”). Participants can vote for the winner of each category on the Alfayha website. Winners in each category will be selected by public voting prior to the Awarding Night. The nominee who receives the most votes in a category will be the winner of that category.

**Eligibility Requirements:** You are only eligible to vote if: 1. You reside in MA, DZ, TN, EG, LB, IQ, JO, SD, DJ, LY, PS, SY, YE, SO, MR, KM, SA, AE, KW, BH, QA, OM. 2. You are at least 13 years of age. 3. You are a registered user with a valid account on the Alfayha platform. 4. You are not an employee, agent, director, officer, or contractor of Alfayha Institute. 5. Your account is not a business account. 6. Your account is not a government, politician, political party, or organizational account. 7. You are not using a VPN or similar tools that obscure or misrepresent your location.

**Voting Rules:** 1. You may cast one vote per category each day. 2. You must be logged in to your Alfayha account to vote at: [voting link].

Alfayha Institute reserves the right to cancel all or part of your votes at any time if you have failed to comply with these Rules or engaged in fraudulent activities on the platform. In case of violation of this paragraph and if it affects the integrity of the Event, we reserve the right to postpone, modify, or suspend the Event. In the event of technical or reporting difficulties with the voting methods, or in the event two (2) or more nominees receive the same number of votes such that the finalists and/or winner(s) cannot be determined, Alfayha Institute reserves the right to make the final determination as to which nominees will be declared the winner of the category.

### 3. PARTICIPANTS Participants will be notified in writing if they are nominated for an award and will be asked to complete a form to accept and validate their nomination prior to the public announcement of the list of nominees. Once a participant has accepted and validated their nomination, they cannot opt-out of the Event. Nominees plus one additional guest will be invited to the Awarding Night in person, held in Dubai. Nominees’ guests must be approved by Alfayha Institute prior to the Event.

Nominated participants agree (i) to take part in any and all marketing, promotional, and publicity requests from Alfayha Institute with respect to the Event; (ii) that Alfayha Institute may use the participant’s name, voice, photograph, likeness, or other personal identifiable information in any media for the promotion and publicity of this Event; (iii) grants Alfayha Institute all consents and waivers necessary, including but not limited to promotional photographs, audio, and/or video recordings of the participant, for Alfayha Institute to run and promote the Event.

Nominated participants shall not, without prior written approval from Alfayha Institute, speak to the press or any other media, or give any interviews or comments relating to the Event and/or Alfayha Institute.

### 4. LIMITATIONS OF LIABILITY 1. To the fullest extent permitted by law, we will not assume any responsibility or liability for (i) any inaccessibility or unavailability of the internet or Alfayha platform; (ii) any technical difficulties or equipment malfunction (whether or not under Alfayha’s control); (iii) any theft, unauthorized access, or third-party interference; (iv) any nomination or prize claim that is late, lost, altered, damaged, or misdirected (whether or not after their receipt by Alfayha) due to any reason beyond the reasonable control of Alfayha; (v) any variation in prize value to that stated in these Terms; (vi) any tax liability incurred by a winner or participant; or (vii) use of a prize. 2. We do not exclude or limit our liability for personal injury or death caused by our gross negligence or fraudulent misrepresentation or any other liability that may not, by law, be limited or excluded. 3. Alfayha Institute and all of our affiliates, including our employees, directors, officers, agents, contractors, and sponsors, to the fullest extent permitted by law, assume no liability whatsoever in relation to your participation (or inability to participate) in this Event, for any direct or indirect damage, loss, or any injury suffered by any entrant participating, or as a result of accepting and/or using any prize, or the use or disclosure of your provided information. Without prejudice to that general exclusion, we will not be liable for any loss of income, profits, sales, or damage to reputation incurred by you. 4. To the maximum extent permitted by applicable laws, each participant agrees to indemnify and hold Alfayha Institute harmless from and against any and all claims, damages, liabilities, costs, and expenses (including legal costs on an indemnity basis) arising from the alleged or actual infringement of any third-party copyright, patent, trademark, or other intellectual property rights, or other rights, any breach of these Terms, and/or arising out of or in connection with the Event.

### 5. GENERAL 1. Participants are responsible for any and all expenses incurred in participating in the Event. Participants will not be reimbursed for any expenses incurred in participating in the Event. 2. If there is any interference with the Event in any way, or if it is not possible to conduct the Event as Alfayha Institute reasonably anticipated, Alfayha Institute reserves the right, at its sole discretion, to disqualify any participant or nomination, or to modify, suspend, terminate, or cancel the Event, as appropriate. 3. In the event of any dispute arising from the Event, or relating to the interpretation of these Rules, Alfayha Institute’s decision shall be final and binding on all parties. 4. This Event does not involve any form of luck or auctions and is based on objective award criteria. Other than as expressly set out in these Rules, Alfayha Institute does not make any promises or commitments about the Event or Platform, such as the specific function of the Event, or its reliability, availability, or ability to meet your needs. The Platform is provided “as is”. To the extent permitted by law, Alfayha Institute excludes all warranties, express, statutory, or implied. Alfayha Institute expressly disclaims the warranty of noninfringement. 5. Participant shall not assign, sell, transfer, delegate, or otherwise dispose of, whether voluntarily or involuntarily, by operation of law or otherwise, any of its rights or obligations under these Rules without Alfayha Institute’s prior written consent. Alfayha Institute may assign these Rules or any of its rights or obligations under these Rules without prior consent of the participant. 6. You confirm that all personal information submitted by you in connection with this Event is true and accurate. 7. We reserve the right to cancel this Event or amend the Rules of this Event at our sole discretion, at any time. 8. If any of these clauses are found to be illegal, invalid, or otherwise unenforceable, then they shall be deleted from these Rules, and the remaining clauses shall survive and remain in full force and effect. 9. To the fullest extent permitted by law, we will not be liable for any failure to perform or delay in performing our obligations under these Rules if an act, omission, event, or circumstance occurs which is beyond our reasonable control.
